One of the most significant OSHA actions of 2016 was issuing guidance on drug testing, injury reporting and safety incentive programs. Rest assured, post-incident drug and alcohol testing is advisable and defensible if employers: Conduct post-incident drug testing in accordance with federal law (Department of Transportation rules, etc.)
